Welcome to Bite & Delight. By accessing our website or placing an order, you agree to these Terms of Service. Please read them carefully before making a purchase.

1. About Us

Bite & Delight ("we", "our", "us") is a New Zealand business specialising in handcrafted, custom-branded food products.

2. Acceptance of Terms

By using our website or placing an order, you agree to be bound by these Terms of Service, our Privacy Policy and any other policies published on our website.

3. Orders

All orders are subject to acceptance and availability.

We reserve the right to refuse, cancel or limit any order at our sole discretion, including where:

  • Products are unavailable.

  • Incorrect pricing or information has been displayed.

  • Payment cannot be verified.

  • Uploaded content breaches these Terms.

An order is not confirmed until payment has been received (unless otherwise agreed in writing).

4. Pricing

All prices are shown in New Zealand Dollars (NZD).

Unless otherwise stated, prices are exclusive of GST.

Prices may change without notice but will not affect orders that have already been confirmed.

5. Payment

Payment is required before production begins unless alternative credit terms have been agreed in writing.

Orders may be delayed or cancelled if payment is not received.

6. Production & Delivery

Production timeframes are estimates only.

While every effort is made to meet requested delivery dates, delays caused by couriers, weather events, supplier shortages or circumstances beyond our control cannot be guaranteed.

Risk in the goods passes to the customer upon delivery.

7. Custom Products

Customers are responsible for ensuring all artwork, spelling, logos, colours and supplied information are correct before approving production.

Once production has commenced, changes or cancellations may not be possible.

As each product is individually handmade, slight variations in colour, print placement and decoration may occur and do not constitute a fault.

8. Intellectual Property

You confirm that you own or have permission to use any logos, artwork, photographs or other content supplied to us.

You agree not to upload any material that infringes another person's intellectual property rights.

You indemnify Bite & Delight against any claims arising from content supplied by you.

9. Acceptable Content

We reserve the right to refuse any order containing content that we reasonably consider to be:

  • Unlawful.

  • Offensive or discriminatory.

  • Defamatory.

  • Hateful or abusive.

  • Sexually explicit.

  • Violent or threatening.

  • Infringing copyright, trademark or other intellectual property rights.

If we decline an order before production begins for these reasons, a full refund will be provided.

10. Returns & Refunds

As our products are freshly baked and made to order, including personalised items, we do not accept returns for change of mind.

Due to food safety requirements, returned food products cannot be accepted.

If your order arrives damaged, incorrect or does not meet the guarantees provided under the New Zealand Consumer Guarantees Act, please contact us within 48 hours of delivery with photographs and your order number.

Where appropriate, we will provide a replacement, store credit or refund in accordance with your rights under New Zealand consumer law.

11. Allergens

Our products may contain or come into contact with:

  • Wheat (gluten)

  • Milk

  • Eggs

  • Soy

While we take care in our production processes, our products are produced in an environment where other allergens may be present. We cannot guarantee that any product is completely free from allergens.

Customers are responsible for ensuring our products are suitable for their intended recipients.

12. Limitation of Liability

To the maximum extent permitted by New Zealand law, Bite & Delight is not liable for:

  • Indirect or consequential loss.

  • Loss of profits or business opportunities.

  • Delays outside our reasonable control.

  • Incorrect information supplied by customers.

  • The use or distribution of customised products after delivery.

Nothing in these Terms limits any rights you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

13. Consumer Guarantees Act

Where goods are supplied to consumers, nothing in these Terms excludes, restricts or modifies your rights under the Consumer Guarantees Act 1993.

If goods are supplied for business purposes, and both parties agree, the Consumer Guarantees Act may not apply to the extent permitted by law.

14. Privacy

Your personal information is collected, used and stored in accordance with our Privacy Policy.

15. Force Majeure

We are not responsible for delays or failure to perform our obligations where such delay or failure results from events beyond our reasonable control, including natural disasters, pandemics, supplier shortages, transport disruptions, power outages or government action.

16. Governing Law

These Terms are governed by the laws of New Zealand.

Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the New Zealand courts.
